Jesse K. Anderson recently won a jury trial in Montgomery County when the trial judge granted his motion for judgment as a matter of law (directed verdict) at the close of the Plaintiff’s case. The lawsuit concerned an accident between two commercial dump trucks wherein the Plaintiff claimed to have suffered bodily injury. The Plaintiff’s allegations were based on negligence through a theory of respondeat superior. After the Plaintiff rested, Jesse argued that the Plaintiff had failed to satisfy his burden of proof and was awarded a judgment as a matter of law by the trial judge, dismissing the case. Tucker v.
